These Terms of Service ("Terms") govern your access to and use of the GC Overseas platform. They form a binding contract under the Indian Contract Act, 1872 and the Information Technology Act, 2000. By creating an account or making a booking, you accept these Terms.
1. Definitions
- GC Overseas / "we", "us", "our" — the air-ticket consolidator and travel agent operating this platform.
- Airline / Carrier — the operating airline that actually performs the carriage.
- User / "you" — any person or business that accesses the platform, makes a booking, or holds an account.
- Booking — a request to reserve one or more airline seats through the platform.
- Ticket — the electronic ticket issued by or on behalf of the Airline evidencing the contract of carriage.
2. Who we are
GC Overseas acts as an agent and intermediary that arranges and books airline seat blocks. We are not the carrier. The contract of carriage is exclusively between you (the passenger) and the operating Airline, and is governed by that Airline's own conditions of carriage and applicable law. We facilitate the booking; we do not operate flights.
3. Eligibility & account
You must provide accurate, current and complete information and keep it updated. You are responsible for safeguarding your login credentials and for all activity under your account. We may suspend or terminate any account for misuse, fraud, chargeback abuse, or breach of these Terms.
4. Booking process & confirmation
A Booking is a request only. It becomes confirmed when a valid booking reference or Ticket is issued after full payment and Airline confirmation. Until then, availability and price are not guaranteed.
5. Pricing, fees & taxes
Fares are dynamic and change until the Ticket is issued — the price is fixed only at ticketing. GST applies as prescribed under Indian law. Convenience fees and service/consolidation charges are non-refundable, even where the Airline refunds part of the fare.
| Charge | Nature | Refundable |
|---|---|---|
| Base fare + Airline taxes | Set by the Airline | Per Airline fare rules |
| GST | Statutory | Adjusted per credit note |
| Convenience / service fee | Our charge | No |
6. Payment, chargebacks & fraud
Payment is collected through our authorised payment partner. Tickets issue only after payment is confirmed. Raising an unjustified chargeback on a validly issued Ticket is a breach of these Terms; we reserve the right to recover the amount and suspend the account. We may decline or cancel Bookings we reasonably suspect to be fraudulent.
7. Passenger information accuracy
You are responsible for ensuring passenger names match the passport/travel document exactly and that all details are correct. Corrections or name changes after ticketing are subject to the Airline's rules and may incur Airline charges or may not be possible.
8. Changes & cancellations
Changes, cancellations and refunds are governed by the Airline's fare rules and DGCA regulations, and are handled as set out in our Refund & Cancellation Policy. Please refer to that policy for charges, timelines and how amounts are processed.
9. Intellectual property
The platform, its content, branding, and software are owned by GC Overseas or its licensors. You may not copy, scrape, resell, or create derivative works without our written consent.
10. Limitation of liability
We are not liable for the acts or omissions of any Airline, including schedule changes, delays, cancellations, denied boarding, baggage or in-flight matters — carriage is under the Airline's conditions and the Carriage by Air Act, 1972. Subject to Section 13, our aggregate liability for any claim is limited to the service/consolidation charge we retained on the affected Booking.
11. Force majeure
We are not liable for failure or delay caused by events beyond our reasonable control, including natural disasters, war, strikes, epidemics, government or Airline action, or network/payment-gateway failures.
12. Governing law & dispute resolution
These Terms are governed by the laws of India. Subject to Section 13, the courts at [City], Punjab shall have exclusive jurisdiction. Grievances may be raised with our Grievance Officer at info@gcoverseas.com under the Information Technology Act, 2000.
13. Your statutory consumer rights
Nothing in these Terms limits or excludes any right you have as a consumer under the Consumer Protection Act, 2019. You may also approach the National Consumer Helpline. For general queries, contact info@gcoverseas.com.
