GC Overseas is an IATA-channel air-ticket consolidator and travel agent, not an airline. Your carriage is performed by the operating airline named on your e-ticket, and that airline's own Conditions of Carriage and published tariff govern the actual flight. The notice below summarises the key rules and international liability limits so you know where you stand.
1. Who carries you
Your contract of carriage is with the operating airline shown on the e-ticket — not with GC Overseas. GC Overseas sources and books seat blocks on your behalf as a booking agent, issues your invoice, and passes your booking to the carrier. The airline's own Conditions of Carriage (published on its website) govern check-in deadlines, boarding, seating, in-flight service, denied boarding, rerouting, schedule changes, and passenger conduct. Any claim relating to the flight itself lies against the operating carrier.
2. International carriage — Montreal Convention liability
International carriage is subject to the Montreal Convention, 1999, given force in India by the Carriage by Air Act, 1972 (as amended in 2009). The Convention governs and may limit the carrier's liability for death or injury, baggage, and delay. Limits are set in Special Drawing Rights (SDR), an IMF currency unit converted to INR at the applicable rate. The current limits, revised with effect from 28 December 2024, are:
| Type of liability | Limit per passenger |
|---|---|
| Death or bodily injury (strict-liability tier) | 151,880 SDR |
| Baggage — destruction, loss, damage or delay | 1,519 SDR |
| Damage caused by delay in carriage | 5,346 SDR |
For death or injury the carrier cannot exclude liability up to 151,880 SDR and may be liable beyond it unless it proves it was not at fault. A higher baggage value can be protected only if you make a special declaration and pay the supplementary charge at check-in.
3. Baggage claims — act within the time limits
Claims against the operating airline are subject to strict deadlines. From the date you receive the baggage, written complaint must reach the carrier within:
- 7 days — for damage to checked baggage.
- 21 days — for delayed baggage.
Keep your baggage tag / receipt and boarding pass; the carrier will require them. Missing these deadlines can extinguish your right to claim.
4. Domestic refunds, cancellations & compensation (DGCA)
For domestic journeys, refunds, cancellations, delay/cancellation compensation and denied-boarding rights follow the DGCA Civil Aviation Requirements (CAR Section 3, Series M) together with your fare rules. Statutory taxes and user development fees are refundable even on non-refundable fares. For how GC Overseas processes any amount due, see our Refund & Cancellation Policy.
5. Travel documents are your responsibility
You are responsible for holding a valid passport, visa, and any health/transit documents required for your entire itinerary, and for ensuring names on the ticket match your passport exactly. A ticket does not guarantee entry to any country. If an airline or immigration authority denies boarding or entry for deficient documents, that is not a service failure by GC Overseas.
6. Dangerous goods & prohibited items
Items classified as dangerous goods under the IATA Dangerous Goods Regulations — including certain lithium batteries, flammables, compressed gases, and other restricted articles — must not be carried in checked or cabin baggage except as expressly permitted by the airline. The carrier may refuse carriage of any person or item for safety or security reasons under its Conditions of Carriage.
7. The carrier's own terms prevail
This page is a plain-language summary for your convenience. Where it differs from the operating airline's own Conditions of Carriage, tariff, or the applicable convention, those documents prevail. This notice does not modify any right or defence available to the operating carrier under the Montreal Convention or the Carriage by Air Act, 1972.
